Peter G. Herman, a director with Tripp Scott, is an experienced litigator who has successfully tried numerous cases at the state and federal levels. Throughout his career, he has handled a wide range of complex commercial litigation matters. He has also represented individuals and businesses in the defense and prosecution of personal-injury claims.
A Martindale-Hubbell AV-rated attorney, Herman has handled claims involving disputes for individuals and corporations, including Browning Ferris Industries, Travelers Insurance, the National Council on Compensation Insurance, Gunther Volkswagen/Mazda, Pompano Park Harness Track, Alamo Rent-A-Car, Columbia Hospitals, Ryland Homes and Frederick R. Harris Inc., the consulting engineer for the construction of the Sawgrass Expressway.
Herman has also been involved with many cases as trial counsel where he has handled issues ranging from insurance coverage disputes to false advertising claims, federal Lanham Act claims and patent infringement claims. He prosecuted a three-year long patent infringement litigation against The Home Depot U.S.A., Inc., where he successfully proved that The Home Depot engaged in willful patent infringement. The jury awarded the client $15 million following a nearly month long jury trial, additional awards in the amount of $3 million in punitive damages, $2.8 million in attorneys' fees, and $3.1 million of prejudgment interest on top of the jury's verdict. Herman also prosecuted a trade secret misappropriation and copyright infringement claim against a large corporation in another month long trial where he successfully proved that the defendant companies intentionally misappropriated his clients’ intellectual property. That case resulted in a $26 million jury award that included $10 million in punitive damages.
Herman is a member of the Court Practice Institute, a diplomat in the Institute in the Science of Trial Advocacy and a former chairman of a 17th Judicial Circuit Ethics Committee. He also serves on the board of directors of the Broward County Chapter of the Federal Bar Association. Herman is a member of the Academy of Florida Trial Lawyers, The Association of Trial Lawyers of America and the Broward County Trial Lawyers.
Herman holds a law degree from Nova Southeastern University Law School and a bachelor's degree from Florida State University.
