A recent Florida Supreme Court ruling could make new condominium and homeowners association laws obsolete for certain associations depending on how their governing documents were drafted.

In Cohn vs. The Grand Condominium Association Inc., the court ruled that unless an association's governing documents contain language that adopts future amendments to the Florida Condominium Act, those associations are no longer subject to new laws.

"It's created a tremendous degree of uncertainty as to what statutes apply to associations," said Zifrony, a real estate attorney for the law firm Tripp Scott that represents condominium and homeowners associations.
